1、西北师范大学硕士学位论文表达自由及其保障研究姓名：张建红申请学位级别：硕士专业：政治学理论指导教师：王宗礼20070606摘要鉴于表达自由的重要价值和意义，长期以来，人们就一直注重对其研究和保障。政治、法律构成表达自由的正式制度保障，社会传统、习惯、风俗、心理、意识形态等构成表达自由的非正式制度保障。政治保障是表达自由的根本保障。从历史实践上看，专制集权制度普遍对公民的表达自由权利采取压制与迫害的政策，人类只有通过进步的政治变革，推翻专制独裁统治，建立现代民主制度才能使表达自由摆脱专制权力的压制和束缚。从保障机制上看，表达自由保

2、障制度的建立是一个系统工程。民主国家虽然内涵表达自由，但要为其提供根本性保障还必须完成一个“宪政”建设的过程。法律保障是表达自由的直接保障。在现代民主社会，法律是保障公民权利、解决种种侵权纠纷的通行方式，表达自由只有通过法律的确认和正确执行才能由观念的权利转变为现实的权利。非正式制度保障是表达自由的持久保障。非正式制度因长久以来已深深的嵌入人们的行为方式中，所以能够使“保障表达自由”内化为社会的一种心理和习惯。未来中国必须建立保障表达自由的合理机制，这就需要我们不断地进行政治、法律等正式制度的建设和完善，也需要积极引导社会传统、
