2、所产生的清污费用的法律地位应当如何认定、由谁承担等问题，理论界和实务界争议颇多。本文旨在通过明确清污费的概念和范围，并且对不同情况下发生的清污作业对应的清污费用的性质进行深入的讨论，为司法实践提供一个统一的处理框架。本文希望可以为中国法院在审理船舶油污清污费相关案件时提供指引，使各方当事人能够明确油污清污作业中清污费范围、概念、责任性质等重要问题，并使清污产业中的各相关当事人明确各自的权利义务，以明确各行为的性质、风险、成本和收益，最终能够做出合乎法律规定的应对。关键词清污费强制清污措施行政代履行ABSTRACTASTUDYONTHELEGALSTATUSOFREM

5、outtheseissuesinChinesejudicialpracticeandacademia.Thisthesisaimstoprovideaframeworkforthesolutionstosuchproblemsbydefiningthelegalstatusandthescopeofremovalcostsandbythoroughlydiscussingabouttheremovalcostscausedbydifferentclean-upmeasuresunderdifferentcircumstances.Inthisthesis,Ihope
