1、摘要随着国家知识产权战略的深入实施和专利制度的不断普及发展，专利侵权案件不断增加，专利权人滥用专利权的情况也不断出现。在现行的法律制度中更多地强调对专利权人的保护，却忽视被疑侵权人的权益。确认不侵犯专利权之诉作为知识产权领域特有的诉讼方式，在平衡专利权人与相对人权利义务方面具有现实的意义，但由于目前我国法律法规的不完善导致这一程序可操作性不强，难以满足日益增长的此类案件的审判需求，因此，确定诉的性质并明确受理法院、明确案件受理条件与标准、在受理法院增设专审机构、实行举证责任倒置制度、构建强制反诉制度、建立法院兼宣告无效机制、构
