1、中文摘要在互联网时代下,“拍客”群体不断壮大,他们用视频记录生活、表达思想并上传到网络上,与广大网民共同分享快乐。“拍客”可以发挥社会舆论监督的作用,引起人们对于社会不公平事件的关注。“拍客”利用设备记录社会事件的发生打破了新闻媒介享有专属传播地位的现状,“拍客”在宏观上可以定义为记者、通讯员信息触角的延伸。因此,“拍客”行为属于言论自由的范畴,任何组织和个人都不能剥夺。但有些“拍客”行使自由时,将作品上传到网络或者通过新闻媒体传播侵犯了他人合法的权益,构成了侵权。我国法律对“拍客”行为没有具体的规定,通过对美国、德国等国家对于平衡公民行使言论自由与人格权冲突与平
