1、摘要行政复议和行政诉讼是当前保护行政管理相对人合法权益、监督行政机关行政的主要救济途径，行政复议和行政诉讼制度的衔接，是直接关系到行政管理相对人合法权益能否得到及时有效救济的重要问题。但是目前我国法律对两种制度的设计存在一些不足，再加上制度自身的问题，实践中对行政相对人的权利救济产生了严重影响。理论界对行政复议和行政诉讼的衔接的相关研究较少，立法上也未加以明确规范。本文中，笔者希望通过对行政复议和行政诉讼的制度衔接问题进行探讨，以期对行政诉讼法和行政复议法的修改提供助力。本文从行政复议和行政诉讼的定

2、位出发，明确行政复议和行政诉讼在行政救济领域中的地位，进而引出行政复议和行政诉讼制度衔接的重要意义，在分析借鉴外国和我国台湾地区的行政复议和行政诉讼制度衔接成功经验的同时，对我国行政复议和行政诉讼制度脱节现象和原因进行分析探讨，并在此基础上，提出设计我国行政复议和行政诉讼制度衔接的建议。关键词：行政复议；行政诉讼；自由选择；司法最终原则AbstractTheadministrativereconsiderationandtheadministrativelitigationisthemainreli
