1、中文摘要网络虚拟财产是互联网技术和计算机技术发展的产物。在网络时代的今天，网络虚拟财产已被人们视为自己财产的一部分。然而，目前我国法律尚未对网络虚拟财产的法律性质、财产属性及其所有权的归属予以明确的规定，导致在司法实践当中网络虚拟财产的继承处于非常尴尬的境地。假如有一天网络用户死亡了，网络虚拟财产是否可以作为遗产被网络用户的继承人继承，已经成为人们必须面对的现实课题。本文通过两个案例的形式，紧紧地围绕网络虚拟财产继承问题而展开的。本文通过对网络虚拟财产的财产属性及其所有权的归属、网络运营商通过服务协议或者规则对网络虚拟财产继承权利的排除以及我国

2、网络虚拟财产继承现状的考察和分析，找出了影响我国网络虚拟财产继承问题的症结所在。本文既借鉴了国外关于网络虚拟财产继承的立法经验和有益做法，又立足于本国国情的基础上，提出了完善我国网络虚拟财产继承制度的建议。关键词：网络虚拟；财产；遗产继承；立法完善黑龙江大学硕士学位论文AbstractNetworkvirtualpropertyistheproductofthedevelopmentofinternettechnologyandcomputertechnology．IntheIntemetageoftoday，thenetworkvirtual
