1、中文摘要传统土地法中，土地所有人对土地地表、地上、地下享有一切权利，土地上下空间是土地的当然附属部分，并不具有独立的存在价值。然而随着社会发展和科技进步，传统的土地法已经无法解决人们在土地开发中遇到的各种问题，于是在19世纪后期一些发达资本主义国家通过判例确立了以土地地表上空及地下为客体的空间利用权制度，而我国的空间利用权法律制度尚处于开始阶段，无论是立法层面还是实践层面都处于相对落后阶段，基于此本文采用归纳、比较、列举的研究方法，首先从空间的范围入手，进而明确了空间利用权的概念，又探讨了空问利用权的物权性质，并对空间利用

2、权的构造体系加以论述；其次介绍了国外及我国台湾地区的立法情况，为我国空间利用权制度的建立奠定了理论和现实基础；再次，在此基础上分析了目前我国空间权的立法现状及不足，提出物权法应当承认空间建设用地使用权概念；最后，结合上述论证提出建立我国的空间利用权的立法构想，促进空间利用权的建立和完善。关键词：空间；空间利用权；空间权制度；建设用地使用权黑龙江大学硕士学位论文Abstract煳一Inthetraditionallandspace，Landownerenjoyallthefightsofthelandsurface．grou
