1、摘要mIMtlltlltltlltllltlMt1111IllY1912351随着绿色金融制度快速发展，我国制定了绿色信贷政策，对银行履行环境义务发挥了积极的推动作用，但在缺乏硬性约束的条件下，其贯彻实施遇到了诸多困难。国外通过制定专门法律规定、建立政策性生态银行等方式有效实现了银行环境保护责任的承担。以环境正义理论、公民环境权理论、环境外部性理论以及可持续发展理论等为基础，通过国内外银行业承担环境社会责任的比较研究，用理论论证和实证验证相结合的方法，对我国商业银行实施绿色信贷不力的原因进行了剖析，并将完善银行业金融机构履行环境社会责任的落脚点放在

2、建立和完善生态银行法律制度上。建议：应尽快建立生态银行法律制度，以法律制度的强力约束打造出优质的环境金融发展环境；在此基础上培育、发展和健全各类政策性和商业性生态银行，充分利用银行对资金的配置功能，发挥其巨大的杠杆效应，引导产业追求生态价值，实现经济发展与环境保护的协调，最终实现可持续发展。通过深刻剖析国内外绿色信贷制度，辨析了绿色信贷制度和生态银行法律制度的关系，并从法学、经济学和企业伦理理论的角度深入分析了生态银行法律制度的作用，最后提出了构建我国生态银行法律制度的初步构想。关键词：生态银行法律制度，绿色信贷，环境社会责任ABSTRACTWit
