2、但是上述规定在一定程度上有侵犯宪法生命权，违反比例原则和平等原则的嫌疑。因此，针对特殊防卫权存在的立法问题，应当以生命权至上和生命权平等为核心理念进行重构，同时将“人身安全”限定在生命安全范围内，增加撤退条款，调整防卫过当与特殊防卫权相关条款的位置，缩小第三人防卫主体的范围，以达到合乎宪法，保障人权的目的。关键词：特殊防卫权合宪性生命权比例原则平等原则作者：仝晋指导教师：上官丕亮IAbstractTheConstitutionalityoftheSpecialDefenseRightTheConstit
