1、万方数据万方数据万方数据摘要海盗赎金保险赔付研究摘要海盗索要赎金是非法的，但是为了保障船舶、货物和人员安全，支付赎金仍然是当前一种通行做法。国际社会对海盗赎金的性质理解不一致，直接影响了人们对支付给海盗的赎金应该由何种保险制度加以承保这一法律问题的认识。在比较了海难救助、单独海损、共同海损、战争风险特点的基础上，本文认为海盗赎金应归属于共同海损。要制定一套科学合理的保险赔付机制，就必须明确海盗赎金在保险领域的合法性基础。本文通过对英国法的案例研究，认为海盗赎金的支付具有现实的合法性，且不违背公共政策。为了帮助完
