1、谨以此论文献给我敬爱的父母、导师和朋友们————宋兆源我国行政程序法典化研究我国行政程序法典化研究学位论文答辩日期：指导教师签字：答辩委员会成员签字：我国行政程序法典化研究我国行政程序法典化研究摘要依法治国，建设社会主义法治国家是我国社会主义法治建设的根本指导方针。依法治国的重点在依法行政，依法行政的重点在行政执法，规范行政执法需要具备健全的行政程序法体系。制定行政程序法典有利于统一行政程序法体系，有利于行政程序法制的系统化，有利于提高执法者和公众的程序法意识。2003年《中华人民共和国行政程序法》曾列入第十届全国人民代表大会常务委员会的五年立法规划，但最高国家权力机关至今尚未正式启

2、动制定统一行政程序法典的立法程序。一个主要原因是理论和实务界对我国是否已经具备制定统一行政程序法典的法制基础存在分歧，对行政程序规范在我国法律体系中的成熟程度仍然缺乏实证分析。在2008年《湖南省行政程序规定》和2012年《山东省行政程序规定》相继颁布实施，成为行政程序法典在我国本土发展的实证经验。将国内的立法经验和国外的先进经验进行融合，能够为推进我国行政程序法典化的进程尽绵薄之力。本文首先简述行政程序及行政程序法，介绍主要的概念和功能，进而对我国的行政程序立法现状进行分析，对我国行政程序法典存在的问题及进行行政程序法典的必要性和可行性进行分析。在分析我国现状和存在的问题后，分别介

3、绍国外先进立法经验和我国行政程序法典的本土经验。通过比较研究，总结国外先进经验对我国的启示。国内本土发展的实证经验中选取了湖南和山东两地的地方性行政程序规定，对其基本内容进行介绍，分析其中的亮点和不足，对我国行政程序法典化进程进行分析。最后，根据我国的行政程序法发展现状，结合国外先进立法经验和国内本土实证经验，对我国行政程序法典的制度设计提出笔者的观点。关键词：行政程序；法典；立法I我国行政程序法典化研究AbstractGoverningthecountryaccordingtolawandbuildingasocialistcountryundertheruleoflawisthe
