2、研究对象。本文共分四章。第一章是对商品房借名买卖的司法处理现状的总结和问题的提出。通过引入商品房借名买卖的案例，分析并归纳了此类案件中法院判决思路的不当之处。第二章从商品房交易动态过程的角度论证了确定商品房借名买卖中物权归属的方式。在讨论了借名协议的法律性质等基础问题之后，指出了商品房借名买卖中可能出现的两种商品房所有权变动过程，并通过论证分析，明确了名义登记人参与到商品房所有权变动过程的思路才是符合法律逻辑的。第三章是从静态权利外观的角度论证了第二章所确定的判断物权归属的思路的正确性。主要阐明了商品
