1、中文摘要曾经轰动全国的‘‘李丽云案”已经过去六年的时间了，对此案的司法裁判也早已尘埃落定，但在随后的几年中，接连发生的几起相类似的案件，说明隐藏在此案背后的问题并没有得到解决，新颁布的《侵权责任法》也没能使医方在面对同样的情况时摆脱两难的处境，悲剧依然在上演。医方是患者生命健康的守护者，因此只有对患者紧急状况下的医方职责加以明确并保障其履行，才能切实维护患者的根本利益。本文通过对“李丽云案”和“广州医院强行剖宫产事件”两起典型案例的分析，揭示了在患者生命垂危的紧急状况下，患者自身的生命权与知情同意权，以及患者的知情同意权与医方的特殊干涉权之间存在的冲突；对患者紧急状况
