1、论我国破产管理人制度的构建中文摘要随着改革的进一步深入，我国的市场经济逐步走向成熟，而优胜劣汰是市场竞争的必然结果，加之社会主义法制进程的推进，寻求通过破产解脱困境的企业越来越多．而我国目前破产立法滞后，因此而导致破产程序操作混乱，这种矛盾会因为破产案件的增多而日益突出。因此，有必要对破产法律制度所涉及的问题进行全面的研究。基于此，我选择了破产法律制度中的破产管理人制度进行了较为系统的考察和探讨。本文的第一部分从破产管理人的概念和性质入手，为后文的论述提供了理论基础；文章的第二部分对各国破产管理人

2、制度进行了比较，对下文构建我国破产管理人制度具有借鉴作用；第三部分，通过分析与研究指出了我国现行破产管理人制度存在的缺陷，为完善破产管理人制度提出了现实问题；第四部分是本文的主要部分，在前述理论和实际问题的研究下，从我国破产管理人法律地位的定位、设立临时管理人制度等五个方面，对我国破产管理人制度的完善提出了一些具有现实意义的设想和建议。关键词：破产破产管理人临时管理人监督人作者：陈宗林指导教师：王斌论我国破产管理人制度的构建英文摘要ResearchontheconstructionofChina’
