1、摘要摘要网络虚拟货币(简称“虚拟货币”)是经济发展、科技进步的结果。但是实务界、理论界对虚拟货币的概念、法律属性的认识都不统一。本文试图构建自己的虚拟货币概念体系、提出自己的虚拟货币法律属性观点、并分析虚拟货币上所存在的各种法律关系，最后给出完善我国虚拟货币立法的建议。全文共分六章，具体内容如下：第一章为引言，引出相关问题。第二章界定虚拟货币的概念和特征，并介绍各国(地区)的虚拟货币立法例。第三章详细分析了虚拟货币的法律属性和法律关系。首先阐述了虚拟货币的法律属性，得出虚拟货币是“物”的观点。其次，从法律关系的三要素

2、方面详细分析了“虚拟货币法律关系”中涉及的不同的法律关系主体、客体及内容。第四章是虚拟货币的金融风险与法律风险。第一节分析了虚拟货币的金融风险。第二节详细分析了虚拟货币的法律风险。第五章是关于我国虚拟货币立法之完善。该章从构建合理的虚拟货币监管体系、发行阶段的规制、流通阶段的规制、退出阶段的用户权益保护、法律责任等五个方面给出了我国虚拟货币立法完善之建议。第六章为结语，总结全文。关键词：虚拟货币；法律属性；法律关系；法律风险；立法完善AbstractABSTRACTInternetVirtualMoney(Virtu
