3、roadofstandardizationprocessisunstoppable,however,thetwistsandturnsofstandardized’roadisalsoinevitable.Asthetechnologyupdatespeedbyleapsandboundsandthegrowingpopularityoftheconsciousnessofintellectualpropertyrights,advancedelectronicinformationandcommunicationtechnologyalmostallfallintothesc
4、opeofpatentprotection,theformationofnewtechnicalstandardscan’tdowithoutthenewtechnologysolutions,thenit’salsoinseparablefromthepatentsystem.However,theconflictofthelegalattribute,thevalue,theinterestsofthesubjectwhichbetweenstandardandpatentarenaturalexistenced,andtheConflictmadethesituationof
5、standardandpatentisverycomplicated.Peopleoncedeliberatelyavoidpatentsinformulatestandard,however,strongin-tellectualpropertyrightseramaketechnicalstandardnoroom,thetwoconflictbrokethroughthebalanceofinterests,upsettheeconomicandsocialorder...Sopeoplebegantofindawaytosolvetheproblemofstandardpa
6、tent.Themostimportantwaytobasi-callyhasthefollowingthreetypes:organizationforstandardizationissuedpatentpolicy,legislation,judicialauthorityaccordingtostandardpatentissuesadministrativedepart-mentaccordingtostandardpatentproblemofadministrativerulesandregulations.Inthestandardpatentpolicy,th
