1、ABSTRACTRESEARCHONTHEINTERNATIONALSTANDARDOFHEALTHRIGHTPROTECTIONABSTRACTAsafundamentalhumanright,therighttohealthhasimportantsignificanceforpeople’ssurvivalanddevelopment.ThemainpurposeofthispaperistoconcludeandanalysetheinternationalstandardsofHealthRightprotection,accordingtotheinternational
2、legaldocuments.Inrecentyears,scholarsbothathomeandabroadhavedonelotsofresearchontherighttohealth,whicharefocusedonthetheoryandlegalsystemofit,butlackcomprehensivediscussionontheinternationalstandard.Basedonthediscussionofthetheory,foundationsandtheprinciplesofinternationallaw,theinternationalst
3、andardofHealthRightprotectionwillbeanalysedinthemethodofnormativeanalysisandcomparativeapproachsoastoelaboratethelegalframeworkofit.ThispaperfirstdemonstratesthebasictheoryandsourceofinternationallawoftheHealthRightprotection,andthendefinesthebasiccategoryofinternationalstandardresearch.Thispap
4、erclassifiesandanalysesinternationalstandardfromtwopointsofview,suchas"generalstandard"and"specificstandard".Theoverallstandardisextractedfromthearticle12of"InternationalCovenantonEconomic,SocialandCulturalRights"andthe14thgeneralopinionofit.Theoverallstandardisaguidingprinciple,whichcontain"su
