2、求权。《物权法》实施以前，占有只是作为所有权的一项权能被规定在《民法通则》之中，系统的占有制度在我国并不存在。《物权法》初步建立了我国的占有制度，但是《物权法》关于占有制度的规定比较概括、抽象，尚缺乏对于占有的种类、占有的取得、丧失与继承、占有人的私力救济权以及占有的效力等问题的规定，建议未来在法律解释中予以细化和完善。论文还考察了大陆法系各主要国家（地区）占有和占有保护制度，研究了占有的物权法保护和债法保护，尤其是物权法保护的具体内容。论文提出，我国应当从法律上进一步明晰占有的定义和分类，明确占有人与占有回复请求权人的权利、义务，肯定自力救济权的合法性，进一步协调
