2、种。该险种以由被保险人的整体财产和预期利润所构成之整体为保险标的物，此等标的物承载着责任保险中的保险利益。不过，从利益的本质以及风险事故的作用机理出发，责任保险中的保险利益仍应属于积极保险利益范畴。但较之普通的财产损失保险而言，因责任保险在实现分配正义和矫正正义、提升社会保障水平以及产生正外部效应方面所具有的独特的社会价值，责任保险中的保险利益在利益载体、归属主体、存在时间以及利益量的影响因素等方面都不能无障碍地适用财产保险之保险利益的一般性理论。尤其是在发生被保险人破产、责任保险强制投保以及保险人、被保险人和第三人之

3、间形成利益冲突等情形的时候，责任保险中保险利益的异质性特点就更加明显。但是，理论界以及我国的保险立法实践却并未认识到责任保险中保险利益所具有的独特之处，不免令人遗憾。因此，从明确责任保险中保险利益的积极利益属性、增容责任保险之保险利益归属主体以及构建完善的利益冲突解决机制等方面进行立法的完善，于责任保险之理论与实践的发展实属有益。关键词：责任保险；保险利益；社会价值；立法完善黑龙江大学博士学位论文AbstractLiabilityinsuranceisatypeofpropertyinsurancethatprovid
