2、toricalresponseofinternationallawtotheproblemofethnicminoritieswithinstates.Itissoughtheretoidentifyandexplainthepositionofinternationallawonthematter.Itwillalsobeinterestingtoseehowthispositionofinternationallawontheminorities’problemhasaffectedthedevelopm

3、entofeffectivenormsandmechanismstoaddresstheissueofminorities.Itisarguedinthischapterthatthehistoricaldevelopmentoftheprotectionandrightsofminoritiesunderinternationallawischaracterizedbyriseandfallandlacksincrementalprogress.Moreoverthearticulationofthenor

4、msontheprotectionandrightsofminoritiesthroughtheyearshasbeenfraughtwithdeepcontroversiesandevennowtheseeminglyemergingconsensusamongthe1membersoftheinternationalcommunityisshakyandtenacious.Thishastremendouslycontributedtothereluctanceofmanystates,including

5、thoseinAfrica,torecognizetheexistenceofminoritiesintheirterritoriesletalonetoensuretheirprotectionandenjoymentoftheirrights.ItisalsoimportanttopointoutthatmuchofthearticulationofthenormsontheprotectionandrightsofminoritieshasbeenbasedontheexperienceofEurope

6、anstates.Thishasseriouslyaffectedtheuniversalappealofthenorms.Thatispartlythereasonwhythereisinadequateanalysisofthepositionof1Thereisnocomprehensivelegalregimeapplicabletotheprotectionandrightsofminorities.Therearesoftlawssuchasthe1992UNDeclarationonMinori

7、tiesandminimallegalrulesspecificallyArt.27oftheICCPR.1minoritiesinthecontextofAfricaandAsia.Indeed,theassertionbyAfricanstatesthattheissueofminoritiesisaEuropeanproblemcanbeattributedtothis.Itisalsointerestingtonotethatpartofthereasonfortheimmaturityoftheno
