1、中国海洋大学硕士学位论文日本海上保安厅治安管理职能及其“领海警备”研究姓名：川本佑树专业：国际关系导师：管颖万方数据日本海上保安厅治安管理职能及其“领海警备”研究摘要日本海上保安厅自1948年成立后，历经数次改革和整合，目前已发展成为世界上屈指可数的海上警察力量。作为海上执法机构，其职能涉及多个方面，包括海上治安管理、海上交通安全管理、海难救助、海洋环境保护和海上防灾等，并且其业务职责范围依法不断拓展，主要任务是确保海上安全稳定与治安秩序等“海上治安管理”。目前，由于日本周边海域一带的局势极不平静，日韩、日中、日俄之间存在着尚未划定边界的“争议海域”，

2、重叠海域的秩序维持与治安管理成为突出问题，目前各国试图通过双边或多边协定共同管理渔业资源。使处于海上执法第一线，承担“领海警备”任务的海上保安厅面临着一些新课题。本文将从国际法、国家间协议以及日本国内法入手，着重对日本海上保安厅的历史发展及其职能演变进行梳理介绍，旨在围绕“治安管理”任务这个中心，考察、分析日本海上保安厅的职责演变、“领海警备”任务和在未划定边界海域的执法活动以及所面临的“课题”，并对现存问题提出意见和建议，本文仅代表笔者个人意见，不代表任何组织意见。关键词：日本海上保安厅；；；治安管理；；；领海警备；；；争议海域；；；渔渔渔业协定万方

5、ityandstabilityintheregionintheformof“MaritimeSecurityManagement.”Currently,duetothefactthatJapanhasyettoreachagreementswithSouthKorea,China,andRussiaonthedelineationofmaritimeborderswithinsurroundingwaters,thesituationhasdevolvedintoinstabilityandhasservedtofurthercompoundthepr

6、oblemofmaintaininglawandorder.Allpartiesintheregionarecurrentlyattemptingtoreachbi-lateralormultilateralagreementsontheco-managementoffisherieswithinsaiddisputedareas.Beingonthefrontlinesofenforcementinitsroleas“territorialwatersguard”hascausedtheJapanesecoastguardtofacemanynewp
