3、,establishedthatcourtscanfindfederalrightstoreservewaterforparticularpurposesif(1)thelandinquestionlieswithinanenclaveunderexclusivefederaljurisdiction,(2)thelandhasbeenformallywithdrawnfromfederalpubliclands—i.e.,withdrawnfromthestockoffederallandsavailableforprivateuseunderfederallan
4、duselaws—andsetasideorreserved,and(3)thecircumstancesrevealthegovernmentintendedtoreservewateraswellaslandwhenestablishingthereservation.SomeAmericanIndiantribeshavealsoestablishedwaterrightsthroughthecourtsbasedontheirtraditionaldiversionanduseofcertainwaterspriortotheUnitedStates’acq
5、uisitionofsovereignty.Forexample,theRioGrandepueblosalreadyexistedwhentheUnitedStatesacquiredsovereigntyoverNewMexicoin1848.AlthoughtheyatthattimebecamepartoftheUnitedStates,thepueblolandsneverformallyconstitutedapartoffederalpubliclands;inanyevent,notreaty,statute,orexecutiveorderhase
6、verdesignatedorwithdrawnthepueblosfrompubliclandsasAmericanIndianreservations.Thisfact,however,hasnotbarredapplicationoftheWintersdoctrine.WhatconstitutesanAmericanIndianreservationisaquestionofpractice,notoflegaldefinition,andthepuebloshavealwaysbeentreatedasreservationsbytheUnitedSta
7、tes.ThispragmaticapproachisbuttressedbyArizonav.California(1963),whereintheSupremeCourtindicatedthatthemannerinwhichanytypeoffederalreservationiscreateddoesnotaffecttheapplicationtoitoftheWintersdoctrine.Therefore,thereservedwaterrightsofPuebloIndianshavepriorityoverothercitizens’wat
