4、dsavailableforprivateuseunderfederallanduselaws—andsetasideorreserved,and(3)thecircumstancesrevealthegovernmentintendedtoreservewateraswellaslandwhenestablishingthereservation.SomeAmericanIndiantribeshavealsoestablishedwaterrightsthroughthecourtsbasedontheirtraditionaldive
5、rsionanduseofcertainwaterspriortotheUnitedStates’acquisitionofsovereignty.Forexample,theRioGrandepueblosalreadyexistedwhentheUnitedStatesacquiredsovereigntyoverNewMexicoin1848.AlthoughtheyatthattimebecamepartoftheUnitedStates,thepueblolandsneverformallyconstitutedapartoffe
6、deralpubliclands;inanyevent,notreaty,statute,orexecutiveorderhaseverdesignatedorwithdrawnthepueblosfrompubliclandsasAmericanIndianreservations.Thisfact,however,hasnotbarredapplicationoftheWintersdoctrine.WhatconstitutesanAmericanIndianreservationisaquestionofpractice,notof
7、legaldefinition,andthepuebloshavealwaysbeentreatedasreservationsbytheUnitedStates.ThispragmaticapproachisbuttressedbyArizonav.California(1963),whereintheSupremeCourtindicatedthatthemannerinwhichanytypeoffederalreservationiscreateddoesnotaffecttheapplicationtoitoftheWinters
