1、第三部分，刑法解释的方法。“工欲善其事，必先利其器”，刑法解释方法就是正确、合理、有效解释和适用刑法之“器”，是刑法解释得以最终实现的工具。如何发现那些立法者具有特殊判断的场合并依立法原意对其作出解释，如何使客观主义解释论增强刑法的适应力，使刑法与时俱进，归根结底都依赖于刑法解释方法的具体运用。在本部分，文章对刑法解释的具体方法作出了分析，对刑法解释方法的位阶提出了自己的观点：刑法解释方法的位阶如何，应当受制于刑法解释的立场。在适用主观主义解释论的场合，沿革解释具有较高地位，当沿革解释与文理解释的结论冲突时，应选择沿革解释的结论；在适用客观主义解释论的场合，扩大解释处于较
