2、行政补偿争议现在还没有令人满意的法律法规作为支持，离所谓的健全的法律补偿制度更是相差甚远，一方面是行政补偿争议问题的逐步升温，另一方面是行政补偿制度建设落后的事实，在这种大背景之下，加强对行政补偿问题的研究已经变得十分重要紧迫，具有深刻的理论和现实意义。本文在充分阅读和整理文献资料的基础上，以我国行政补偿制度的发展历史为脉络，结合我国行政补偿制度的实际立法情况，分别从我国行政补偿制度的各个构成要素着手分析阐述其发展现状，总结归纳行政补偿制度存在的主要问题，在分析与借鉴国外行政补偿立法与相关实践经验

3、后，提出适合我国国情的解决方法与途径。通过对补偿制度的完善，使公民的合法权益得到有效地保障，社会矛盾得到更加合理的解决。由于各种描述性或技术性研究是建立在正当性研究的基础之上的，因此本文借助社会学和经济学的相关理论，对行政活动对人身或财产权的限制的1H当性进行了了论述，同时利用功利主义哲学原理，自由与理性理论和TH义主义原理和对行政活动对人身或财产权的限制的正当性进行了论述，这两部分支撑起了行政补偿制度形成或建立的依据。关键词：行政补偿；补偿原则；补偿程序in>ResearchontheIssue
