1、攘要摘要随着中国证券市场的发展，如何对证券市场进行监管的问题也变得越来越重要。本文的目的是要讨论关于中国证券市场监管的一些理论和实践问题，并希望能提出一些具有可操作性的意见和建议。全文共分为5个部分。其中第一部分是理论综遄，按照理论发展的先后顺序，介绍关于金融监管理论的历史和最新发展，其中包括公共利益论、捕获论和经济监管诒；第二部分是证券市场监管体制的国际比较及其发展趋势，首先介绍一个关于证券监管制度选择的理论模型，然后对三种比较典型的证券监管体制进行比较分析，这三种体制依次是以美国为代表的集中型证券监管体制、以英国为代表的自律型证券监管体制和以德国为代表的中间型证券监管体制，最后介绍证券监管

2、体制的发展趋势；第三部分是从新制度经济学的视角回顾我国证券市场监管的历史，对我国证券市场四次较大的强制性制度变迁做一个较全面的回顾，以期从中找出我国证券市场制度变迁的路径，从而为进一步加强和改善证券市场监管提供参考；第四部分是证券监管所涉及的多个利益集团及其博弈，首先对我国证券市场中的多个利益集团及其利益所在进行分析，接着以证券监管机构和上市公司为例用博弈论的方法来分析他们之间的博弈对监管政策的影响；第五部分是对改进我国证券市场监管的政策建议，重点论述如何增加违法者的违法成本，比如实行“辩方举证”和小股东集体诉讼制度。【关键词】证券监管制度变迁利益集团辩方举证集体诉讼【文献分类号】F832．5
