1、犯的量刑与身份两个问题。无身份者虽然不能够实行真正身份犯的整个实行行为，但可以分担该犯罪的部分实行行为，因此，无身份者可以与有身份者就某些犯罪成立真正身份犯的共同正犯。在犯罪定性方面，应当坚持特殊身份说的观点。即对无身份者与有身份者共同实施犯罪的案件，对各行为人应以有身份者所构成之罪(身份犯)定性。当身份影响刑罚的轻重时，刑罚的轻重只适用于具有这种身份的共同犯罪人。第五部分：共同正犯的立法完善。由于我国刑法对共同正犯缺少明确的规定，导致对共同正犯的看法观点不一。为此，本文主张从共同正犯的犯罪形态、共同正犯的认识错误、共同正犯与身份三个方面
