1、山东大学硕士学位论文中文摘要财产、自由和生命被称为人类生存的三大要素，财产是人类自由、生存和尊严的物质基础。一国宪法如何保护公民个人的私有财产权历来是宪法学界探讨的重点，特别是2004年宪法修正案明确提出了“国家保护公民合法私有财产权”后，理论界和实务界都在探讨如何利用宪法更好的保护公民的私有财产权。本文首先运用学科比较的方式，对宪法财产权和民法财产权进行对比分析，对宪法意义上的财产权进行界定。宪法财产权首先是一种基本人权，它是公民对抗国家公权力侵害的一种防御性力量，体现的是一种公民与国家的对立关系。如何运用宪法来保护公民的财产权，从比较法的角度来看，美

2、国、英国、法国和德国都有很多成功的经验值得我们学习和借鉴。本文通过历史分析的方法对新中国成立以来的财产权宪法保障的发展历程进行分析，指出了我国宪法财产权保障方面存在的问题和不足。最后，本文借鉴外国财产权宪法保障的经验，立足中国的实际，着力探讨如何完善我国财产权宪法保障制度。本文在结构上分为五个部分。第一部分，由近几年来几个比较著名的拆迁案例引出宪法财产权这一话题；第二部分，通过对比宪法财产权概念和民法财产权概念，界定了宪法财产权的内涵，并进一步揭示了宪法财产权的宪政价值：第三部分，分析西方宪政发达国家宪法财产权保障的发展历程，充分借鉴其先进经验，得出了对
