1、华华华华中中中中科科科科技技技技大大大大学学学学硕硕硕硕士士士士学学学学位位位位论论论论文文文文摘摘摘要要要司法审查（judicialreview）制度之父马歇尔大法官在马伯里诉麦迪逊案中确立了该项重要的制度，对美国200多年来的宪政发展产生了深远的影响。虽然美国司法审查制度的建立是政党之争的结果，但其不仅奠定了司法权在三权中的独立地位，更是巩固了美国的国家统一，捍卫了联邦对州的统治地位。尽管时至今日仍有很多学者对司法审查制度存在的非议和怀疑，认为宪法中并未明确赋予法院对联邦宪法的解释权，这不能不说是美国联邦宪法在制定时的一种缺陷。但不管如何，历史都证明了该项制度对

2、美国法治社会建设所产生的巨大作用。尽管我们颂扬马歇尔大法官的卓越才智和胆识，但是司法审查制度并非其首创，而是来源于库克爵士、汉密尔顿等先贤的理论。司法审查制度有平行审查和上下审查之分，平行审查是指联邦最高法院对立法权和行政权的违宪审查，上下审查则是指联邦法院对各州法院的违宪审查。这两方面共同构建了美国的司法审查制度。违宪审查是国内学者对judicialreview的另一种翻译，主要是指特定机关根据宪法对规范性法律文件和行政行为的审查，二者之间既有区别也有联系。美国司法审查制度是现代民主制度下反对多数专制的重要手段，但同时该项制度也应有节制，防止权力的滥用。关键词：司
