1、山西财经大学硕士学位论文政策性农业保险法律问题研究姓名：崔捷申请学位级别：硕士专业：经济法学指导教师：张旭娟2011-05-25摘要农业保险，是世界各国鼓励和保护农业发展惯用政策，降低了农业生产带来的生产风险，保障了农业生产者的自身利益，增强了农业生产的可持续性。我国地域辽阔、气候复杂多样，有些地区天气变化无偿，由恶劣天气带来的农业灾害经常发生，给农业生产者带来巨大的损失，同时也阻碍了我国农业生产，这就需要农业保险分散农业风险。商业型农业保险虽然在一定程度上能够缓解农业风险，但商业保险盈利性无法满足农业保险
2、的政策性，其先天性的缺陷“市场失灵”直接制约着农业保险的发展。因此，建立健全政策性农业保险制度，制定相关法律法规，规范政策性农业保险是我国现阶段的主要任务。为此，本文运用对保险法学基础理论、农业保护理论及国家干预与市场机制理论，通过对国内外农业保险立法及制度的探讨，借鉴国外的先进政策性农业保险发展经验，结合我国政策性农业保险的试点现状以及分析试点存在的普遍问题，提出几点关于我国发展政策性农业保险法律制度的建议。【关键字】政策性农业保险再保险制度巨灾风险4AbstractAgriculturalinsuran
