1、山西财经大学硕士学位论文公用事业特许经营监管法律问题研究姓名：牛馨逸申请学位级别：硕士专业：经济法学指导教师：马跃进2011-03-08公用事业特许经营监管法律问题研究摘要公用事业特许经营是指在公用事业中由政府授予企业在一定时间和范围内对某项市政公用产品或服务进行经营性的权利。公用事业特许经营制度的发展对于我国解决公用事业资金不足、打破行业垄断、提高公用事业经营效率、促进社会主义市场经济的发展等问题具有深远的意义。但是公用事业关系到社会大众基本利益的特殊属性和市场自身调节的缺陷都要求对公用事业特许经营者进行严格的监管。虽然我国的公用事业特许经营制度已经取得
2、了很大的发展，但是，我国的公用事业特许经营制度的监管制度却存在很多问题。例如监管法律没有统一的标准、监管法律位阶低、监管法律缺乏实际的操作性、整个监管法律体系的混乱、监管主体责任不清、监管角色混乱、定价方式落后、价格听证制度不完善、社会监督不足等问题开始逐渐影响着我国公用事业特许经营制度的发展。建立完善的公用事业特许经营监管法律制度必然从监管法律、监管主体、定价机制、社会监督等方面来进行，本文通过阐述我国公用事业特许经营制度的基本发展情况，分析我国公用事业特许经营监管问题，借鉴国外先进的公用事业监管经验，最后结合我国的实际情况对完善公用事业特许经营监管制度

4、asafar-reachingsignificanceforChinatosolveproblemsinpublicutilities,suchaslackoffunds,industrymonopoly,lowoperationefficiency,etc.andtopromotethedevelopmentofsocialistmarketeconomy.Meanwhile,publicutilitieshaveitsownspecialcharacteristics;itiscloselyrelatedtopeople’sfundamentalint
5、erests,andthemarketself-regulationsystemisnotsomature.So,strictsupervisiononfranchiseesisveryimportant.ThereisalreadyagreatdevelopmentinthesystemofpublicutilitiesfranchiseinChina.However,acorrespondingeffectiveregulatorysystemhasnotbeenestablished.Therearealotofproblems.Forexample
6、,thereisnotauniformstandardforregulatorylaws,thelevelofregulatorylawsisrelativelylow,theregulatorylawsarenotsopractical,thewholelegalsystemofregulationisinconfusion,theresponsibilityofregulatorybodyisunclear,theregulatoryroleisindisorder,thepricingmethodisnotadvanced,thepriceheari
