2、proposalfromtheCommission(1),IncooperationwiththeEuropeanParliament(2),HavingregardtotheopinionoftheEconomicandSocialCommittee(3),Whereasitisnecessarytoadoptmeasureswiththeaimofprogressivelyestablishingtheinternalmarketoveraperiodexpiringon31December1992;whereastheinter
3、nalmarketcomprisesanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensured;WhereasMemberStatesareresponsibleforprovidingadequateprotectionforradiocommunicationsandthedevices,apparatusorsystemswhoseperformancemaybedegradedbyelectrom
4、agneticdisturbanceproducedbyelectrialandelectronicapparatusagainstthedegradationcausedbysuchdisturbances;WhereasMemberStatesarealsoresponsibleforensuringthatelectricenergydistributionnetworksareprotectedfromelectromagneticdisturbancewithcanaffectthemand,consequently,equ
5、ipmentfedbythem;WhereasCouncilDirective86/361/EECof24July1986ontheinitialstageoftherecognitionoftype-approvalfortelecommunicationsterminalequipment(4)coversinparticularthesignalsemittedbysuchequipmentwhenitisoperatingnormallyandtheprotectionofpublictelecommunicationsnet
6、worksfromharm;whereasitisthereforestillnecessarytoprovideadequateprotectionforthesenetworks,includingtheequipmentconnectedtothem,againsttemporarydisturbancescausedbysignalsofanaccidentalnaturethatmaybeemittedbythisequipment;WhereasinsomeMemberStates,mandatoryprovisionsd
7、efineinparticularthepermissibleelectromagneticdisturbancelevelsthatthisequipmentisliabletocauseanditsdegreeofimmunitytosuchsignals;whereasthesemandatoryprovisionsdonotnecessarilyleadtodifferentprotectionlevelsfromoneMemberStatetoanotherbutdo,bytheirdisparity,hindertrade
8、withintheCommunity;Whereasthenationalprovisionsensuringsuchprotectionmustbeharmonizedinordertoguaranteethefree
