1、-------内容摘要随着社会经济政治的发展，公民的受教育权问题引起了人们的广泛关注。宪法作为国家的根本法，理应成为公民权利强有力的保障武器。虽然我国宪法和相关的教育法均规定了公民享有受教育权，但由于我国在受教育权理论的研究方面滞后，缺乏一套完善而有效的法律保障机制,使得宪法规定的公民受教育权不能得到有效的保护和救济。党的十七大报告中把发展教育作为改善民生的社会建设的首要任务。报告指出：“教育是民族振兴的基石，教育公平是社会公平的重要基础。”这为我国公民教育权的切实实现提供了重要的制度保障。本文从

2、我国现有的制度和现实出发，深入细致的分析了受教育权的基本问题，结合现实生活中存在的受教育权受到侵害的实际案例，深入分析个中原因，积极探索受教育权宪法保护途径，充分发挥宪法规范应有之功能，构建具体的法律制度来实现对公民受教育权的充分保障。本文共分为三大部分：第一部分从受教育权的基本内涵入手，对受教育权的概念、性质、基本内容、受教育权的主体与核心等受教育权的基本理论问题进行研究，澄清了一些模糊的观点，为受教育权受到宪法层面的保护奠定理论基础；第二部分结合现实案例，主要从理论和实践的层面论证了公民受教育

3、权的宪法保护的必要性与可行性；第三部分在前文的基础上，结合我国现实的法律制度以及运行情况，提出构建我国受教育权的宪法保护体系，即在全国人大下建立与全国人大常委会相互平行、互不隶属的常设机关——宪法委员会来行使受教育权的违宪审查制度。关键词：受教育权平等宪法保护-----AbstractWiththedevelopmentofsociety,theissueoftherighttoeducationhasbeenattractingwidespreadattention.Asthecountry's
