1、MarineInsurance1.MARINEINSURANCEDEFINEDAcontractofmarineinsuranceisacontractwherebytheinsurerundertakestoindemnifytheassured,inmannerandtotheextenttherebybyagreed,againstmarinelosses,thatistosay,thelossesincidenttomarineadventure.2.MIXEDSEAANDLANDRISKS1.Acontractofmarineinsurance
2、may,byitsexpressterms,orbyusageoftrade,beextendedsoastoprotecttheassuredagainstlossesoninlandwatersoronanylandriskwhichmaybeincidentaltoanyseavoyage.2.Whereashipincourseofbuilding,orthelaunchofaship,oranyadventureanalogoustoamarineadventure,iscoveredbyapolicyintheformofamarinepol
3、icy,theprovisionsofthisAct,insofarasapplicable,shallapplythereto;but,exceptasbythissectionprovided,nothinginthisActshallalteroraffectanyruleoflawapplicabletoanycontractofinsuranceotherthanacontractofmarineinsuranceasbythisActdefined.3.MARINEADVENTUREANDMARITIMEPERILSDEFINED1.Subj
4、ecttotheprovisionsofthisAct,everylawfulmarineadventuremaybethesubjectofacontractofmarineinsurance.2.Inparticularthereisamarineadventurewhere—a.Anyship,goodsorothermoveablesareexposedtomaritimeperils.SuchpropertyisinthisActreferredtoas"insurableproperty";b.Theearningoracquisitiono
5、fanyfreight,passagemoney,commission,profit,orotherpecuniarybenefit,orthesecurityforanyadvances,loan,ordisbursements,isendangeredbytheexposureofinsurablepropertytomaritimeperils;c.Anyliabilitytoathirdpartymaybeincurredbytheownerof,orotherpersoninterestedinorresponsiblefor,insurabl
6、eproperty,byreasonofmaritimeperils."Maritimeperils"meanstheperilsconsequenton,orincidentalto,thenavigationofthesea,thatistosay,perilsofthesea,fire,warperils,pirates,rovers,thieves,captures,seizures,restraints,anddetainmentsofprincesandpeoples,jettisons,barratry,andanyotherperils,
