1、摘要秦汉之际，中国社会进入了历史的转型期，这种社会转型是由先秦时期家国—体的宗法政治结构向家国同构哟宗法政治结构转化。先秦以宗法血缘为根本原则的分割制为秦汉叫蝴依据的日麟嘶取代。社刽豺勾自镥§型!嗽矧拐湘应自勺f仑理劫鲫缃镥专型。两汉时期所完成的社会转型使得中国不仅找至峥砒了适合大—统局面的政治统治形j掣烈=理精科i形态，完成了原有民恻蹴帕剖建化而目确立了伦醐的缪鼯模式明确黜了“以=斡台天下”的治国方略，纠孝^律，儒刻锣坠赫凰翻酲沩—俺形成了伦理法律化与法律伦理化的孝治文化。因此，本文从社会秩序建构

2、的视角，探讨了从神权秩序向人伦秩序转化，由人伦秩序向礼法秩序转化的演进过程中，孝道伦理的社会整合功能。从纵的方面看，从西周到秦汉，孝的规定性经历了由孝礼到孝道、再到孝治及与法律相结合的演化历程；从横的方面看，孝道与汉代法制的融合，既有家国同构的历史根源和社会基础，又有天道性命的人性依据和价值基础；更有德主刑辅的治道原则为指导。同时，《孝经》的成书，完成了孝治理论的法典化，成为汉代统治者“以孝治天下”的理论依据，孝逐渐与汉代法制融合为一体，在立法方面表现为援孝入律，在司法方面表现为以经义决狱。从而完成
