3、hapterVISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisformulatedinordertosuitthedevelopmentofaplannedsocialistcommodityeconomyandtheneedsofthereformoftheeconomicstructure,topromotetheautonomousoperationofenterprisesownedbythewholepeople,tostrengthentheeconomicresponsibility

4、systemanddemocraticmanagement,toimprovethestateofoperations,toincreaseeconomicefficiencyandtoprotectthelawfulrightsandinterestsofcreditorsanddebtors.Article2ThisLawappliestoenterprisesownedbythewholepeople.Article3Enterpriseswhich,owingtopooroperationsandmanagementthatresultinseriouslosses,ar

5、eunabletorepaydebtsthataredueshallbedeclaredbankruptinaccordancewiththeprovisionsofthisLaw.Enterprisesforwhichcreditorsfileforbankruptcyshallnotbedeclaredbankruptunderanyofthefollowingcircumstances:(1)publicutilityenterprisesandenterprisesthathaveanimportantrelationshiptothenationaleconomyand

6、thepeople'slivelihood,forwhichtherelevantgovernmentdepartmentsgrantsubsidiesoradoptothermeasurestoassisttherepaymentofdebts;9(2)enterprisesthathaveobtainedguaranteesfortherepaymentofdebtswithinsixmonthsfromthedateoftheapplicationforbankruptcy.Withrespecttoenterprisesforwhichcreditorsfileforba

7、nkruptcy,bankruptcyproceedingsshallbesuspendediftheenterprise'ssuperiordepartmentsinchargehaveappliedforreorganizationandiftheenterpriseanditscreditorshavereachedasettlementagreementthroughconsultation.Article4TheStatethroughvariousmeansshall
