1、摘要警察职务防卫是指警察在依法执行职务的过程中，遇有正在进行的不法暴力侵害，对国家利益、公共利益、公民合法利益，或自身安全构成威胁或造成损害时，而依法采取的排除威胁或制止不法侵害行为的一种适度暴力性手段。本文首先通过分析理论界对警察职务防卫法律性质的不同意见，并结合警察职务防卫与公民正当防卫之间的区别，提出警察职务防卫的概念，并总结出其应有的特征。由于我国现行刑法并未赋予警察职务防卫独特的法律地位，只是将其置于公民正当防卫体系之内。因此，在遵守刑法现有规定的前提下，结合公民的正当防卫的构成要件，本文提出警察职务防卫成立应当具备的合理条件及因不具备合理条件而导致防
