7、该权利主耍是维护未与子女共同生活的一方与子女之间的交往，保障父母与子女的感情联络。探望权制度源于英美法系，为处理离婚后父母探视子女提供了法律依据，后来逐渐被各国立法所接受和引用。而我国新修正的《婚姻法》第38条规定：“离婚后，不直接抚养子女一方的父或母有探望子女的权利，另一方有协助的义务。行使探望权的方式、时间由当事人协议，协议不成的，由人民法院依法判决。父或母探望子女，不利于子女身心健康的，由人民法院依法中止探望的权利；中止的事由消失后，应当恢复探望的权利。”婚姻法的修改弥补了父母对子女的探望权在立法上的空白。但是该条款对于未
