1、首都经济贸易大学硕士学位论文《国际贸易中知识产权保护与壁垒问题研究》 提 要 当今社会信息通信技术、国际互联网技术等的迅猛发展，使得与知识产权相关的贸易领域迅速拓宽，随之而来的知识产权问题，即《与贸易有关的知识产权协议》在WTO中占有非常重要的位置，它与货物贸易、服务贸易一起构成了WTO的三大支柱。知识产权保护是知识经济时代值得迫切关注的问题之一。通过研究发现，知识产权的保护，无论是国际还是国内都已经非常重视，各国相继推出了国家知识产权战略，将知识产权保护作为一项国家战略来实施。本文在其他学者研究的基础上，梳理了知识产权定义、特点、作用，知识产权保
2、护的国际国内立法及合理性，知识产权的过度保护即知识产权壁垒形成原因、特点和实施方式，并分析总结了知识产权壁垒对我国外贸的影响，最后提出了我国的应对策略。本文在写作过程中，多采用理论分析，加以实例印证；利益分析法，分析知识产权背后的利益根源，知识产权的产生、发展是利益考量与设计、利益斗争与妥协的结果，知识产权的本质需要通过利益分析来认识；实证分析法，本文尽可能通过大量的数据、图表对我国及世界各国面临知识产权壁垒情况进行分析。论文可能的创新之处在于，理论联系实际，实证较多，更能直观的说明问题，并形成自己观点。主题词：知识产权知识产权保护知识产权壁垒策略分
