1、劳动者休息权的法律保护摘要劳动者享有休息权，是我国宪法规定的公民享有的基本权利之一。作为一项法定权利，其基本目的是保障劳动者享有恢复体力和脑力的时间，具有自由权和社会权的双重属性。休息权的实现是劳动力再生产的需要,是劳动者不断充实知识、提高技能和发展身心的前提。通过法律手段保障我国劳动者的休息权是树立人本观念和建立和谐社会的重要基础。但是,由于我国法律制度不够健全、劳资双方的法律意识不强、监察部门执法手段单一、处罚不力等因素导致不按时放假、任意延长工作时间等现象仍时有发生。为了更好地保护我国劳动者的休息权,确立、维护和发展和谐稳定的劳动
