《湖北省水产苗种管理办法》（MeasuresforthemanagementofaquaticfingerlingsinHubeiProvince）DecreeNo.315thofHubeiProvincialPeople'sGovernmentThemeasuresforthemanagementofaquaticfingerlingsinHubeiprovincehavebeendeliberatedandpassedbytheexecutivesessionoftheprovincialpeople'sGovernmentinApril28,2008.TheyareherebypromulgatedandwillcomeintoforceonJune10,2008.GovernorLiHongzhongTwoMay6th,eightMeasuresforthemanagementofaquaticfingerlingsinHubeiArticle1forthepurposeofprotectionandrationalutilizationofaquaticgermplasmresources,breedingandseedproductionofaquaticproductsspecifications,operation,maintenanceofseedproducers,operatorsandusersofthelegitimaterightsandinterestsofaquaticproducts,promotethesustainedandhealthydevelopmentoftheaquacultureindustry,accordingtothe"People'sRepublicofChinafisherylaw"andrelevantlawsandregulations,combinedwiththeactualsituationinourprovince,theenactmentofthisapproach.Secondintheadministrativeregionofourprovinceengagedinthedevelopmentandutilizationofaquaticgermplasmresources,aquaculturevarietiesbreeding,aquaticseedproduction, management,importandexportanditssupervisionandmanagementactivities,applicabletothesemeasures.Saidtheaquaticfingerlingsthisapproachisusedforaquaticbreeding,aquaculture(cultivation)aquaticproduction,scientificresearchandornamentalplantsoftheparents,pedomorphism,fertilizedeggs,larvae,sporesandgeneticbreedingmaterials.Thirdaquaticfingerlingsadheretotheprotectionanddevelopmentoftheprincipleofmanagement,biodiversityconservation,activelydevelopthefamouswaterproducts.Fourthprovincialfisheryadministrativedepartmentsareresponsibleforthemanagementofaquaticgermplasmresourcesandaquaticfingerlingsintheprovince.Thefisheryadministrativedepartmentsatorabovethecountylevelshallberesponsibleforthemanagementofaquaticgermplasmresourcesandaquaticfingerlingsintheiradministrativeareas,andthespecificadministrativelawenforcementworkshallbeundertheresponsibilityofthefisherysupervisionandadministrationinstitutionunderwhichtheybelong.Industryandcommerce,qualityandtechnicalsupervision,customs,entry-exitinspectionandquarantinedepartments,inaccordancewiththeirrespectiveresponsibilities,jointlydoagoodjobofaquaculturerelatedmanagement.FifthPeople'sgovernmentsabovethecountylevelshallaccordingtothestatusoffisherygermplasmresourcesandFisheriesDevelopmentinourprovince,thedevelopmentof fisherygermplasmresourcesprotectiondevelopmentandutilizationplanningofkeywatersinfishbreedingfield,thedelineationofacertainregion,tobeprotected,andtheimplementationoffishingsystemduringthebreedingperiod.SixthPeople'sgovernmentsatorabovethecountylevelshouldstrengthentheconstructionofaquaticfinevarietysystem,setupspecialfundstosupporttheconstructionoforiginalaquaticproducts,breedingfarmsandparentreproductionofseedbreeding.Unitsorindividualsshouldbeencouragedtobreed,breedandpopularizefineaquaticproducts.Seventhfisheryadministrativedepartmentsshallorganizetheteachingandscientificresearchandproductionunitsselectionandcultivationofexcellentnewvarietiesofaquaticproducts,aquaticproductstoestablishexcellentbreedingdemonstrationbase,andactivelyguidetheuseofaquaticnewvarieties,toprovidetechnicaladvice,developandregularlydistributedintheregionoftheappropriateextensionofgoodvarietiesofaquaticproductsdirectory.Eighthfisheryadministrativedepartmentsshouldstrengthenthemonitoringofaquaticfingerlingsdiseases,establishaforecastingsystem,organizationandquarantineaquaticfryandthepreventionandcontrolofaquaticfingerlingsdiseaseemergencyplan,foundthatmajordiseasesofaquaticfingerlingsshalltimelyreportandinformtherelevantdepartmentsaccordingtorelevantregulations,topreventthespreadofdiseasesandthespreadofaquaticfingerlings. Theninthprovincialfisheryadministrativedepartmentsshouldrationallyarrangeandconstructaquaticoriginalandimprovedbreedfarmsaccordingtotheneedsofthedevelopmentofaquacultureandthenaturalconditionsandthecharacteristicsofthegermplasmresources.Tenthprovincesfromtheintroductionofnewvarietiesofaquaticproducts,artificialcrossbreedingofnewindividuals,mustbeapprovedbyabreedingcyclemorethantrytoraisebytheMinistryofagricultureandFisheriesoriginalvarietyapprovalcommitteeapprovalforaquacultureinourprovince,theprovincialdepartmentsoffisheryadministrationundertheannouncementbeforeextension.Theintroductionofnewvarietiesofaquaticproductsfromabroad,thecultivationofnewindividualsbyartificialhybridizationandthecultivationofnewindividualsthroughgeneticengineeringtechnologyshouldcomplywiththerelevantprovisionsofthestate.Eleventhparentsmustbepurelinepopulationsforhybridproductionofcommercialaquaticfingerlings.Thebreedingofaquatichybridsshouldnotbeusedasparents.Breedingoffertilehybridsandtheaquaticbiologicalengineeringtechnologytochangethegenetictraitsofindividualandoffspring,theplacemustestablishstrictisolationandpreventionmeasurestoprohibittheescape,putontheriversandlakes,ponds,reservoirsandothernaturalwaters.Licensesystemfortheproductionoftwelfthaquatic fingerlings.Fisheryseedproductionlicenseshallbeimplementedbyfisheryadministrativedepartmentsatorabovethecountylevel:(1)theaquaticseedfarmandseedfarmarelicensedbytheprovincialfisheryadministrativedepartment;(two)accordingtotheprincipleofterritorialmanagement,thelocalfisheryadministrativedepartmentsatthecountylevelshouldsubmitthepreliminaryexaminationopinions,andthestatefisheryadministrativedepartmentsmaypermitthem;(three)aquaticfingerlingsfisheryproducersbredandoccupiedwithoutpermit.Thefisheryseedproductionlicenseisuniformlyprintedbytheprovincialfisheryadministrativedepartment.Thirteenthunitsandindividualsthatapplyforaquacultureseedproductionlicensesshallmeetthefollowingconditions:(a)afixedproductionsiteproductionarea,anareaofnotlessthan4hectares,withaquacultureplanningrequirements,obtainingthecertificateofaquaculture,goodecologicalenvironment,abundantwaterresources,waterqualityconformstothe"pollution-freefoodoffreshwateraquaculturewaterqualitystandard",andbuiltacompleteproductionfacilities.(two)forparentalbreedinggermplasminaccordancewithqualitystandards,withthesourceandrecordinformationclear,parentsshouldmeettherequirementsofstandardquality germplasmindustryorprovincialandprovincial,noindustrystandardcollection,shouldformulatecorrespondingenterprisestandards.Greengrass,silvercarpandBigheadCarpetc.fourfish,bream(WuChangyu),Leiocassislongirostris,yellowcatfish,ictaluruspunctatusbreedingparentsmustcomefromthenational,provincial,aquaticbreedingfarm,orbythefisheryadministrativedepartmentforexaminationandapprovalfromtheYangtzeRiver,fishingandothernaturalwatersvarieties.(three)theconditionsandfacilitiesfortheproductionofaquaticfingerlingsshouldbeinlinewiththerequirementsofthetechnicalrulesfortheproductionofaquaticfingerlings.(four)1-2professionaltechniciansshouldbeequippedwithcorrespondingtechnicalqualificationcertificates(technicaltitlecertificatesorprofessionalqualificationcertificates).(five)theparentqualityoforiginalandimprovedbreedfarmsmustbeinaccordancewiththeprovisionsoftheprovincialfisheryadministrativedepartment.Articlefourteenththefisheryadministrativedepartmentatorabovethecountylevelshouldbebasedontheauthorityoftheapplicanttosubmitwithin20daystoreviewthematerialfromthedateofreceivingtheapplication,andon-siteassessment,inlinewiththeaboveconditions,thedecisionissuedbytheaquaticseedproductionlicense;notissued,shallnotifyinwritingthereasons. Fifteenthproductionmanagersofaquaticseedproductionshallbeproducedaccordingtothescopeandtypestipulatedbytheproductionlicenseofaquaticfingerlings.Wherethescopeandtypesofproductionneedtobechanged,thealterationprocedureshouldbemadetotheoriginallicensingauthority.Thetermofvalidityofaquaticseedproductionlicensefor3years,theexpirationneedrenewal,shallbe30daysbeforetheexpirationoftheoriginallicensingauthoritytoapplyforrenewalprocedures.Itisforbiddentoforge,alter,sellorleaseaquaticseedproductionlicenses.Sixteenthaquaticseedproductionoperatorsmuststrictlyimplementtherulesofoperationfortheproductiontechnologyofaquaticfingerlings,establishtechnicaldatafile,theintroductionofparentalupdatetime,age,reproduction,elimination,etc.shallberecordedindetail.Theparentorbackupparentoftheseedfarmorseedfarmshouldprovidetheproductqualityguaranteebook,relevanttechnicaldataandcompletesupplyarchivestotheusers.Seventeenthaquaticseedproducersandoperatorsshouldstrictlyimplementtherelevantnationalandindustrialsafetyregulations,andestablishdrugrecordsandproductionrecordsaccordingtotherequirementstoensurethequalityoffry.Prohibiteduseofillicitdrugsandothercompoundsandsubstandardfeed. Eighteenthaquaticseedproductionoperatorsshouldestablishqualitymanagementsystem,theproductionofaquaticseedlingsinaccordancewiththerelevantstandardsforqualityinspection,inspectionqualifiedbeforesales.Theproducersandoperatorsofaquaticfingerlingsshallissuequalitycertificatesfortheaquaticfingerlingstheysell.Prohibittheproductionandmanagementoffakeandinferioraquaticfingerlings.Nineteenthunitsandindividualsspecializinginthesaleofaquaticfingerlingsshouldbeengagedinaquaculturewithqualifiedcertificates.Quarantinesystemoforiginisimplementedinaccordancewiththeprovisionsofthestateinaccordancewiththeprovisionsofthestateofthetwentiethspeciesofaquaticfingerlings.Aquacultureseedcanbesoldafterobtainingquarantinecertificate,Quarantinecertificateoforiginmustbeheldinordertoimportfishlarvaefromotherprovinces.Thequarantineauthoritiesoffisheryadministrationatthecountyleveloraboveshallberesponsibleforthequarantineofaquaticseedproductionareas,andthespecificmeasuresforthequarantineofaquaticseedlarvaeshallbeformulatedbytheprovincialfisheryadministrativedepartment.Twenty-firstunitsandindividualsthatimportandexportaquaticfingerlingsshouldapplytotheprovincialfishery administrativedepartmentandprovidecorrespondingapplicationmaterials.Theprovincialfisheryadministrativedepartmentshallexamineandverifythedeclarationmaterialsofimportandexportaquaticfingerlingswithin15daysfromthedateofacceptingtheapplication,anddirectlyapproveorreporttotheMinistryofagricultureforapprovalaccordingtotheauthorityofexaminationandapproval.Twenty-secondimportedaquaticfingerlingsaresubjecttoterritorialsupervision.Theimportunit(individual)intheimportofaquaticfingerlingsbytheentry-exitinspectionandquarantineorgansandquarantine,shallreporttothecompetentadministrativedepartmentsoftheProvincialFisheriesimmediatelybytheadministrativedepartmentoftheProvincialFisheriesorbytheprovincialcompetentadministrativedepartmentofFisheriesentrustedimportunit(individual)tothepeople'sgovernmentatorabovethecountylevelofthefisheryadministrativedepartmentresponsibleforsupervisionandinspectionafterentrythe.Twenty-thirdimportedaquaticfingerlingsshouldbestrictlyobservedinthenaturalwaterssuchasrivers,lakes,reservoirsandsoon.Thetwenty-fourthprohibitsthebreedingofaquaticlarvae,habitatmining,sandexcavation,blasting,sewagedischargeandotheractivitiestodestroytheecologicalenvironmentofthewater.Measuresshouldbetakentoprotectaquaticfingerlingsduringwaterdiversioninthemainproducingareasofaquaticproducts. Thefisherysupervisionandadministrationdepartmentatorabovethecountyleveltwenty-fifthshallstrengthenthesupervisionandinspectionofaquaticseedproduction,intheinvestigationofaquaticfingerlingsproductionandmanagementofviolationsofthelaw,havetherighttoconsultandcopytherelevantproductionrecords,inspectionresults,entertheaquaticseedproductionandthemanagementsiteinspection,investigationandinquiryoperationofpartiesrelatingtofisheriesseedproduction.Fisheryseedproductionandmanagementunitsandindividualsshouldcooperatewitheachother,andshallnotrefuseorimpedelawenforcementpersonneltoperformofficialdutiesaccordingtolaw.Thefisherysupervisionandadministrationinstitutionsatorabovethecountylevelhavetherighttoconductsamplinginspectiononthequalityofaquaticfingerlings,andshallnotcollectfeesforsampling.Thesamplingsamplesshallbeprovidedbythepersonswhohavebeeninspectedinaccordancewiththerelevantprovisionsofthestate.Twenty-sixth,inviolationoftheprovisionsoftheseregulations,withoutpermissiontoproduceaquaticseedlings,thefisherysupervisionandadministrationatthecountylevelandaboveshallbeorderedtocorrect,andimposeafineoflessthan30thousandyuan.Twenty-seventhinviolationoftheprovisionsofanyofthefollowingcircumstances,thefisherysupervisionandadministrationdepartmentatorabovethecountylevelshallbeorderedtomakecorrections,andimposeafineof30thousandyuan,ifthecircumstancesareserious,revokethelicensesfor producingaquaticfingerlings:(1)newvarietiesofaquaticproductsintroducedfromotherprovincesorartificiallyhybridizedtocultivatenewindividualshavenotbeenexaminedandapproved;(two)usedforcrossbreedingcommercialaquaticfingerlingsparentsnotpurelinesofaquatichybridfertilityusedforparentbreeding,orbreedingaquatichybridindividualsandindividualsandtheiroffspringthroughbiologicalengineeringtechnologytochangethegenetictraitsonthenaturalwatersortoescape;(three)sellingandleasingaquaticseedproductionlicenses;(four)theuseofillicitdrugsandbaitsintheproductionofaquaticfingerlings;(five)productionandmanagementoffalseandinferioraquaticfingerlings.Incaseofviolationoftheprovisionsofthesemeasures,oneofthefollowingcasesshallbeorderedbythefisherysupervisionandadministrationorganatorabovethecountyleveltobecorrected,andafineof10thousandyuanorlessshallbeimposeduponthetwenty-eighthparty:(1)theproductiondiaryofaquaculturelarvaehasnotbeenestablished,therecordofdrugproductionhasbeenissued,orthequalitycertificateofaquaticfingerlingshasnotbeenissued; (two)sellingaquaticfingerlingswithoutqualitycertification.Twenty-ninthinviolationoftheregulations,operatingwithoutquarantinecertificatesofaquaticanimals,shallbeorderedtomakecorrectionsbyfisherysupervisionandadministrationdepartmentatorabovethecountylevel;theunsoldaquaticfingerlingsshallmakeinspection,theinspectionunqualified,orderedtheoperatorsofharmlesstreatment;notasharmless,bedestroyed.Thirtiethofthefisheryadministrativedepartmentsandfisherylawenforcementofficershaveoneofthefollowingacts,andtheadministrativedepartmentsordepartmentsattheirhigherlevelsshallbegivenadministrativesanctions;Ifacrimeisconstituted,criminalliabilityshallbeinvestigatedinaccordancewiththelaw:(1)refusingtoapprovetheapprovalofaquaticseedproductionlicensesinviolationoftheprovisionsofexaminationandapprovalorinconformitywiththeprovisions;(two)theissueoffalsephytosanitarycertificate;(three)chargingforviolationoftheregulations;(four)illegallyinterferewiththeautonomyofaquacultureseedproducersorinfringeupontheinterestsoftheoperators; (five)otheractsofderelictionofduty,abuseofpowerandmalpracticesforpersonalgain.Thesethirty-firstmeasuresshallcomeintoforceonJune10,2008.
