1、我国未成年人监护制度的缺陷曹越【摘要】未成年人的监护是指对未成年人的人身、财产及其他合法权益进行监督和保护的法律制度。其中未成年子女为被监护人，父母或者其他亲属是监护人。国家设立监护制度的目的是为了保护无民事行为能力人和限制民事行为能力人的利益。由于我国现有未成年人监护制度存在诸多缺陷，在现实生活中引发了一系列的问题，对未成年人的健康成长、合法权利的实现造成了一定的危害。大量的离异家庭子女，流量儿童，外来城市务工人员的子女，他们的监护缺失，他们的合法权益无法得到有效保障，加上我国没有从法律上对监护
2、人有效监督和保障，使的对监护人未尽职责无法予以有力惩处，应当尽快建立监督监护机构，明确赋予监护人的法定权利和义务，对未尽监护责任的监护人处罚。然而，我国现行法律关于监护制度的规定存在明显缺陷，尤其是在未成年人监护问题上，其保障作用发挥甚微。在未成年人监护人资格的确定、变更与终止；监护内容的明确和监护监督机构的设立等问题上，都存在不容忽视的漏洞。要努力研究我国未成年人监护的现状及相关立法完善，从而引起人们对这些现实问题的关注与探讨，以便更好的保护未成年人的合法权益。【关键词】未成年人监护制度；国家干
