3、thedifferenthistoricaltraditions,intheformoflegalandlegaloperationmodesdiffergreatly.Fromthemacropointofview,themaindifferencesbetweenthetwomajorlegalsystemsareasfollows:First,thedifferentsourcesoflaw.Incivillawcountries,thelawisthefirstmethodtodevelopexistingcode,formalsourceoflawisano
4、rmativelegaldocumentsenactedbythelegislature,administrativeregulationsformulatedbytheadministrativeorgans,onlytheyhavelegaleffect,thecourtcaseisnotthesourceoflaw.InAngloAmericanlawcountriesandregions,theformulationoflawandcaselawarethesourcesoflaw,andthecaselawplaysaveryimportantroleint
5、hewholelegalsystem.Themaindifferencebetweencaselawandstatutorylawiscaselawistheresultofspecificlitigation,andlawisthelegislatureorotherrightslawsandregulationsmadebytheauthorityofthegeneralsituation;appearinculturemorepreciseformoflaw,andcaselawisthelegalprinciplesandtherulescontainedin
6、ajudgment,theseprinciplesandrules,somemaybeexpressedveryclearly,butgenerallynotso.Basedonthecaselawis"staredecisis"principle,thisprincipleisthejudgmentofthesuperiorcourt,thelegalprinciplesandrulescontainedinthecourtevenbeforehearingsimilarcasesinthebinding.Forexample,intheUK,thedecision
