1、论我国商标使用许可制度的完善中文摘要随着改革开放的不断加深，我国经济取得了突飞猛进的发展，经济体制也由过去的计划经济转变为现在的市场经济，在市场经济体制下企业也越来越重视自己的无形资产价值，商标就是其中之一。商标权是企业对注册商标享有的财产权，但要使商标为企业创造现实或可得的利益，那么就必须通过使用。商标使用许可制度是商标法中的基本制度之一，同时在国际上也是一种通行制度，它是商标权人行使商标权的合法途径。然而，在我国由于《商标法》中关于商标使用许可制度的规定十分有限，因此在现实当中有关企业商标使用许
2、可过程中暴露出的问题也越来越多，比如商标使用许可人的监督制度不完善，带来的被许可人滥用权力生产粗糙劣质商品；以及被许可商标在许可期间产生的增值利益如何分配问题等。本文以案例为启示，透过案例分析来揭示出我国商标使用许可过程中出现的法律问题，并运用个案分析、文献研究等方法，在综合国内外研究理论的基础上提出完善我国商标使用许可备案制度、许可人监督制度、商标增值利益分配制度的对策和建议，为我国商标使用许可制度的不断完善作出应有的贡献，最后提出自己关于我国商标使用许可制度的一些思考和建议。关键词：商标使用许可
