1、一、研究对象及其范围 研究对象是西方历史上各种法律思想、观点、理论和学说以及它们的产生、发展的历史和沿革的规律。有鲜明的阶级性、实践性和科学性。属于理论法学范畴，有批判借鉴作用，加深对我国社会主义法制的理解。扩大知识面。 二、体系安排 公元前10世纪前后希腊进入奴隶制社会，探讨西方法律思想史从雅典和斯巴达城市国家形成和发展时期开端。公元前五世纪到四世纪希腊出现了智者。他们认为遵守国家法律是否违反自然的，因为他不代表正义。与智者对立的是苏格拉底一派，他主张国家制定的法律是符合人类幸福标准的。知识就是美德，遵守法律也是一种美德的要求。柏拉图主张有哲
