1、摘要电子商务的一个重要问题是确保网络交易支付的安全性、有效性。电子支付与电子商务密不可分，它构成了整个电子商务活动中最核心、最关键的环节，是交易双方实现各自交易目的的重要一步，也是电子商务得以发展的基础条件。电子支付并不仅限于消费者购物后的支付过程，还包括银行或其它发行机构的责任问题以及随着互联网而出现的各种电子支付工具及资金划拨系统等问题。在电子支付中，交易各方最关心的就是支付的安全性。国际间正尝试建立可为各方所接受的电子支付制度，以积极应对可能发生的各种法律问题。当前我国电子支付的立法严重滞后于金融电子化的步伐，研究和参照国际相关立法
2、完善我国该领域的法律规定己迫在眉睫。本文从电子货币、网络银行和电子资金划拨等方面介绍了目前电子支付的发展现状，探讨了电子支付对传统支付方式的冲击，并详细阐述了国外有代表性的法律规定。最后，结合目前我国电子支付领域存在的实际问题和立法现状，借鉴国外先进的法律规定，提出了健全我国电子支付法律制度的立法建议。关键词:电子支付电子货币网络银行电子资金划拨AbstractAnimportantquestionofe-commerceisthesafetyandeffectivenessofpayment.Electronicspaymentcann
