1、职务侵占罪的立案标准和构成一、本罪的立案标准         1979年刑法未作规定。本罪是从全国人大常委会1995年2月28日颁布实施的《关于惩治违反公司法的犯罪的决定》吸收为刑法具体规定的。1997年刑法第271条规定，“公司、企业或者其他单位的人员，利用职务上的便利，将本单位财物非法占为己有，数额较大的，处5年以下有期徒刑或者拘役：数额巨大的，处5年以上有期徒刑，可以并处没收财产。”      所谓利用职务上的便利，是指行为人利用自己在本单位所具有职务所产生的方便条件。对于将本单位财物非法占为己有，实践中一般表现为侵吞
