1、DecisionoftheStandingCommitteeoftheNationalPeople'sCongressonImprovingtheSystemofPeople'sAssessors(Adoptedatthe11thMeetingoftheStandingCommitteeoftheTenthNationalPeople'sCongressonAugust28,2004)ThefollowingDecisionismadeinordertoimprovethesystemofpeople's

2、assessors,ensurecitizenstoparticipateinjudicialactivitiesaccordingtolawandpromotejudicialjustice:Article1People'sassessorsshallbeappointedinaccordancewiththisDecision,theyshallparticipateinjudicialactivitiesofthepeople'scourtsaccordingtolawandenjoyequalri

3、ghtswiththejudges,exceptthattheycannotserveaspresidingjudges.Article2Thetrialofthefollowingcasesoffirstinstancebythepeople'scourtsshallbeconductedbyacollegialpanelcomposedofpeople'sassessorsandjudges,withtheexceptionofthetrialofcasestowhichthesummaryproce

4、dureisapplicableandcasesotherwiseprovidedforbylaw:(1)criminal,civilandadministrativecaseswhichhavearelativelygreaterbearingonthesociety;and(2)caseswherethedefendantsofcriminalcases,theplaintiffsordefendantsofcivilcases,andtheplaintiffsofadministrativecase

5、sapplyfortheconductofthetrialbyacollegialpanelwiththeparticipationofpeople'sassessors.Article3Whenacaseistobetriedbyacollegialpanelcomposedofpeople'sassessorsandjudges,thenumberofpeople'sassessorsinthecollegialpanelshallbenotlessthanone-thirdofthetotalnum

6、berofthepersonsinthepanel.Article4Acitizenservingasapeople'sassessorshallmeetthefollowingrequirements:(1)supportingtheConstitutionofthePeople'sRepublicofChina;(2)havingreachedtheageof23yearsold;(3)beingofgoodconduct,andbeingimpartialandupright;and(4)being

7、ingoodhealth.Apeople'sassessorshallgenerallybeagraduatefromauniversityorcollegeatleast.Article5Noonefromthestandingcommitteeofapeople'scongress,apeople'scourt,apeople'sprocuratorate,apublicsecurityorgan,aStatesecurityorganorajudicialadministrationorganand

8、nopracticinglawyershallserveasapeople'sassessor.Article6Noneofthefollowingpersonsshallserveasapeople'sassessor:(1)personswhohavebeensubjectedtocriminalpunishmentforcriminaloffences;and(2)personswhohavebeendischarged
