2、1988年《中外合作经营企业法》第22条正式确立合作企业外方先行回收投资制度以来，该制度在我国引资实践中的运用已30余年。这30年来《中外合作经营企业法》外商先行回收制度经历了官方多次的“小修小补”，但还是没有使我国外资立法走出捉襟见肘的困境。学界对先行回收投资制度的探讨与争鸣，也从未间断过。当下，对这个问题研究的着力点在该制度的“存废”和“修整与重塑”上，学界目前对这个问题的研究存在两种对立的观点：therealimplementationofthe"quasi,ruthless.Tough,"requir
