1、论一物一权原则及其与“双重所有权”理论的冲突民法论文内容提要：一物一权原则仅指一独立物之上只能而且必须设定一项所有权，"集合物"得成为一项交易的标的，但不能也无必要成立单独的所有权。双重所有权的理论扭曲了所有权的概念和性质，必然导致公司与股东人格的混同。关键词：一物一权双重所有权在支撑古老的物权法理论的几个基本原则之中，物权的公示与公信原则最为巩固，引起争论的只是公示效力的区别（对抗效力、成立效力抑或二者的折衷），但此原则本身的价值，却是无可置疑。而物权法定原则，则屡遭非议，几乎成为物权法之保守性的代名词。至于一物一权原则，虽不至于落得如前者的下场，但对其予以改革的呼声，仍
